The Safety and Health Review Commission is an independent administrative adjudicatory body created by North Carolina General Statute § 95-135 to hear contestments of citations, penalties, and abatement periods issued by the Occupational Safety and Health Division of the North Carolina Department of Labor. The review by the Commission is a two tiered process with an evidentiary hearing held by Administrative Law Judges throughout the state. Decisions of the Administrative Law Judges may then be appealed to the three member Commission which is appointed by the Governor. The Board's decision may be appealed first to the Superior Court and then to the North Carolina Court of Appeals and finally to the North Carolina Supreme Court.

Periodic Review of Rules

N.C. Gen. Stat. §150B-21.3A, as adopted in 2013, requires state agencies to review existing rules every 10 years. An initial review will be completed during the next five years, and thereafter rules will be reviewed on a 10-year review cycle. The NCOSH Review Commission rules are located in Title 13 of the NC Administrative Code and Title 24 of the NC Administrative Code. The Commissions’ rules are currently under review and available for comment.  The Rules in Title 13 have been designated by the Review Commission to be unnecessary because they were replaced  in 1992 by the current rules found in Title 24. Public comments on the OSHRC’s initial determination will be received until August 11, 2014.  Please direct all comments to Felicia Gore Hoover, General Counsel, OSH Review Commission 422 N. Public comments means written comments objecting to the rule, in whole or in part, received by the agency from any member of the public or an organization.  Comments must address the content of the rule to be considered by the Commission.

There is nearby street parking on Polk Street, North Street and Blount Street.  Paid visitor parking is available on Jones Street (between Wilmington and Blount). We also have one visitor space beside the office in Lot 35 Space 238 for people on short visits to the office to file.
